MyPCX ACCOUNT TERMS OF USE

MyPCX ACCOUNT is a service provided and operated by PC EXPRESS, thru PCX ONLINE website at www.pcx.com.ph which allows you to maximize access to PC Express's web site and to carry out site-wide transactions by letting you sign in just one time. MyPCX ACCOUNT is site-wide user account that will allow you to order online, join our mailing list, keep track of support tickets, and join our community forum.

MyPCX ACCOUNT service is provided to you subject to the following Terms of Use. This Terms of Use constitutes a legal agreement between you and PC Express. You must accept without modification all the terms and conditions contained in this Terms of Use in order to access and use on-line services.

Some of the on-line services may be governed by posted guidelines, rules, or other general terms and conditions. All such guidelines, rules, terms and conditions are incorporated by reference into this Terms of Use. In case of a conflict between such other guidelines, rules, terms and conditions, this Terms of Use will prevail.

The Terms of Use may be updated from time to time without formal notification. You can review the most current version of this Terms of Use statement here. Your continued use of the site following any modification will be considered to constitute acceptance of such modifications.

SERVICE DESCRIPTION

MyPCX ACCOUNT provides users with access to a wide range of PC Express's products and services, including mailing list, forums, support tracking, online ordering through its web site, PCX Online.

You understand and agree that services via on-line are provided to you "AS-IS" and "AS-AVAILABLE" such that PC Express assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

For e-commerce transactions such as online ordering, you are responsible for the fees that these services will require necessary for the processing of these transactions. You are also responsible for obtaining access to on-line which may involve third party fees (such as internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display or delivery of advertisements. In addition, you must provide and are responsible for all equipment necessary to access the MyPCX ACCOUNT service.

REGISTRATION REQUIREMENTS

For you to be able to use MyPCX Account, you must first register yourself and consequently:

a) Provide true, accurate, current and complete information about yourself as prompted by the Service's registration form.

b) Maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

If you provide any information that is untrue, inaccurate, not current or incomplete, or PC Express has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, PC Express has the right to suspend or terminate your account and refuse any and all current or future use of on-line (or any portion thereof).

Upon registration, you will be asked for a Sign-in name and Password. You are responsible for maintaining the confidentiality of the password and for all activities that occur under your password or account. PC Express can not and will not be liable for any loss or damage arising from your failure to take full responsibility on the confidentiality of your password. In addition, this Terms of Use shall bind and be deemed to apply to any person who gains access to on-line sites, whether or not the same is authorized by the registered user.

While PC Express strives to deliver to you a wide depth of products and services as it works at its best to provide the most accurate, up-to-date content available, you understand and agree that:

1. Erroneous/objectionable content. PC Express does not control 100% of the content posted via on-line and as such, does not guarantee the accuracy, integrity or quality of such content.

PC Express Online does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within its products/brands catalog and/or pricelist. PC Express may make changes to this information, or to the products described therein, at any time without notice. Content available on participating brands may include inaccuracies, typographical errors, or outdated information. 2. No Online Service Warranties Honored. Online Services provided to you are on an "AS IS" and "AS AVAILABLE" basis. PC Express expressly disclaims all online service warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

No advice or information, whether oral or written, obtained by you from PC Express or through or from the online service shall create any warranty in your favor.

3. Links and Promotions. This site may contain links to other sites on the Internet that are owned and operated by third parties. The linked sites are not under the control of PC Express and PC Express is not responsible for the content of any linked site or any link contained in a linked site. PC Express reserves the right to terminate any link at any time. If you decide to access any of the third party web sites linked to this site, you do this entirely at your own risk. You acknowledge that PC Express is not responsible for the operation of or content located on or through any such site.

Your business dealings with, or participation in promotions of advertisers and merchants found on on-line sites, including payment and delivery of related goods or service and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such business entities. You agree that PC Express will not be responsible or liable for any loss or damage of any sort incurred as a result of any such dealings and as a result of the presence of such advertisers on the service.

4. Booking Discretion. PC Express, without liability on its part, PC Express reserves the right to refuse or cancel orders at any time, including but not limited to parties with insufficient or invalid billing and shipping information, orders that contain incorrect prices or product descriptions, orders in which PC Express believes the customer has violated applicable laws, and orders that PC Express believes are harmful to PC Express or its affiliates. Parties with denied orders will be notified as to the reason for refusal.

PC Express, without liability on its part, also reserves the right to limit the number of items purchased or ordered through the site, and the areas to be served for delivery which may be beyond the serviceable areas of its logistics partner.

5. Defective Product/Delayed Deliveries/Canceled Deliveries. PC Express makes no warranty that the service will meet your requirements; the service will be uninterrupted, timely, secured or error-free; the results that may be obtained from the use of the service will be accurate or reliable; the quality of any products, service, information, or other materials purchased or obtained by you through the site will meet your expectations; and any errors in the software will be corrected.

6. Risk of Loss. All items purchased from www.pcx.com.ph are made pursuant to a shipment contract; the risk of loss and title for such items pass to you upon our delivery of the items to the carrier.

7. Information downloading. Any material downloaded or otherwise obtained through the use of the service is at your own discretion and risk. You will be solely responsible for any damage to your computer system for loss or damage that results from the download of any such material.

8. Erroneous Account Processing. PC Express shall not be held liable for erroneous account purchases due to technical problems, timeliness, deletion, mis-delivery or failure to store any user communications at the time of the transaction. PC Express shall clarify, upon presentation of viable records, erroneous account purchases made online at PC Express's web site. Customer concerns relating to and concerning account transactions will be entertained by PC Express under the conditions of this clause.

9. Confidentiality of online information. Information in the internet is not 100% secured. PC Express, though subject to its Privacy Policy, will not be held liable and does not warrant the 100% confidentiality of any such information.

10. Suggestions/comments. www.pcx.com.ph welcomes comments on e-commerce transactions made online and your suggestions on how to improve the site. Any comments, ideas, suggestions, information, or any other content you contribute will be deemed voluntary, royalty-free, perpetual, and irrevocable, which www.pcx.com.ph shall be free to adopt, publish, reproduce, disseminate, transmit, distribute, copy, use, create derivative works from and utilize in whatsoever manner without additional approval or consideration.

INDEMNIFICATION

You agree that PC Express shall not be liable to you or to any third party for any modification, suspension or discontinuance of its services.
